Rising parental separation rates or divorce rates in India have put the focus squarely on Indian Family Court System, especially its role in protecting the rights of children of separated parents. However, a detailed online survey of parents and legal professionals reveals a failed and dysfunctional system in need of urgent reforms.

As part of our endeavour to initiate a conversation about children of separated parents, we are inviting legal and mental health professionals from across the world to form a consensus around reforms in our family courts system that would truly further the best interests and welfare of our children.
In a number of ways, India and Israel are similar societies – both are relatively conservative and deeply religious or spiritual depending on one’s choice of words and place a significant emphasis on families. Therefore, I am particularly excited to welcome our guest today, who is a personal friend and a guide, Justice Philip Marcus.

Justice Philip Marcus is an Israeli jurist, who has built upon his experience as a judge of Israel Family Court since its opening in 1997 till his retirement in 2012 to usher in reforms as a consultant, researcher, writer and lecturer on Family Law and Family Courts, professional ethics and jurisprudence. He is widely acknowledged as an expert on family law, child custody disputes and child protection. He is a consultant to committees of the Knesset (Israel’s parliament) on all proposed legislation concerning children, the elderly and persons with disabilities. He is a member of national and international organizations dealing with families in distress and therapeutic jurisprudence, has lectured in countries across five continents, and is consulted by countries and organizations around the world about Family Court system reforms.
